What Every Illinois Divorce Client Should Understand About Mediation Before Signing Anything

Mar 17, 2026 | Video Transcripts

Mediation has become one of the most talked-about options in divorce cases, and for good reason. It can save time, reduce legal fees, and give both parties more control over the outcome. But mediation is not always the right choice, and agreeing to the wrong terms can have consequences that last for years.

At KHK Family Law & Divorce Attorneys in Chicago, we believe that every client deserves to fully understand their options before making a decision that will affect their finances, their custody arrangement, and their future. With more than 70 years of combined experience in family law, our team has seen what happens when mediation works well and what happens when it does not.

The Appeal of Mediation

Mediation is appealing because it offers a way to resolve a divorce without the drawn-out process of litigation. A neutral facilitator, usually an attorney or conflict resolution professional, meets with both parties and works through the disputed issues one by one. The goal is to narrow down the disagreements and find resolutions that both sides can accept.

When mediation works, it can reduce a case that might have taken three years in court to something that is resolved in six to twelve months. A private mediator typically charges about the same hourly rate as an attorney, but you are paying one professional instead of two, and the focus is on resolution rather than fighting. That is where the real savings in time, stress, and legal fees can happen.

Mediation also works best when both parties are willing to communicate and negotiate in good faith. If that willingness exists, mediation can prevent the emotional and financial toll of a prolonged court battle.

What Can Go Wrong in Mediation

The risk of mediation is that it can be a double-edged sword. In the pressure of the moment, people sometimes agree to things they later regret. They may give up custody time, financial support, or property because they believed those issues were harder to win than they actually were.

Without an attorney who knows the local judges and understands how the court is likely to rule on specific issues, a client has no way of knowing whether the deal on the table is a good one. They may walk away from mediation thinking they made a fair compromise, only to realize later that they gave up something they could have won in court with the right representation.

This is one of the most important reasons to have experienced legal counsel during mediation. At KHK Family Law & Divorce Attorneys, we inform our clients about their rights and what they are realistically likely to win or lose at trial before they agree to any terms. That knowledge is the difference between a mediation that serves your interests and one that costs you for years to come.

Understanding the Litigation Alternative

When mediation is not possible or not in a client’s best interest, litigation becomes the path forward. In Illinois, divorce litigation involves filing motions, presenting evidence, and attending hearings before a judge. There are no juries in Illinois divorce cases. The judge makes every decision, which is why having an attorney who has appeared before your judge and understands their tendencies is so valuable.

Litigation also includes a tool called the pretrial conference, where attorneys meet informally with the judge to advocate for their client’s position. The judge then offers a settlement proposal. In many cases, the pretrial process leads to a resolution faster than mediation because the weight of the judge’s input pushes both sides toward agreement.

Litigation is more complex than mediation. It involves sworn statements, hearings, testimony, and sometimes a full trial. But for cases where the parties cannot communicate, where one side is not negotiating in good faith, or where the stakes are too high to leave to a mediation compromise, litigation is the appropriate and necessary path.

Why the Right Attorney Changes Everything

Whether your divorce is resolved through mediation or litigation, the quality of your legal representation will shape the outcome. An attorney who understands both processes can help you avoid the pitfalls of mediation while also being fully prepared to fight for you in court if necessary.

At KHK Family Law & Divorce Attorneys, Attorney Matthew Katz combines over 20 years of family law experience with a Master’s in Social Work from the University of Chicago. That combination of legal knowledge and understanding of family dynamics allows our team to approach every case with both strategy and empathy. Our staff includes professionals fluent in English and Spanish, and we bring training in psychology and business to every case we handle.

We do not believe in a one-size-fits-all approach. Every family is different, and every divorce requires a strategy built around the specific circumstances of the case.
